From Our Allamakee ATV/UTV Club President & Vice:
Let’s join the chat- Officially- on the SMV (Slow Moving Vehicle) Signage on rigs and the legal focus on OHV’s.
After a bunch of chatter, your Club leadership has dug deep and spoke with many offices concerning this matter. Here is the outcome for your guidance:
Regulations: Currently, it has been noted that HF2130 does not require a SMV sign specifically on your vehicle to ride on the roads.
Under Motor Vehicles and Law of the Road, Iowa Code 2025, §321.383; that was overlooked when HF2130 was put in place; it requires a SMV sign for any vehicle going 35 MPH or slower. Specifically: “…any other vehicle principally designed for use off the highway…” This would include ATVs & UTVs
Enforcement: In conversation with the State Police Headquarters and various Allamakee Law Enforcement offices, we have been advised that:
1. Law Enforcement is under no guidance to focus on the OHV community
2. It is up to each Officer’s discretion to pull over any vehicle for probable cause.
3. Main items they are looking for specifically with OHV’s are:
a. Speed
b. Open Container(s)
c. Child restraints/Safety
Future:
The club is working on trying to obtain a variety of signage to help meet the club’s needs. More information to follow.
In addition, we are exploring an open forum discussion with local enforcement for both our club members and the public.
BLUF (Bottom Line Up Front)
Until HF2130 is amended, it is up to you to do your due diligence to be safe on our roads. It is recommended that you do place a reflective device in accordance with the standards (triangle).
Specifics:
1. It must be placed center OR left center of the vehicle and be highly visible.
2. If you are trailering the rig- YOU MUST remove or cover the SMV signage.
